Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Abair Language Learning App (the “App”), provided by Abair Pty Ltd (“Abair,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) Who We Are

2) Eligibility

You must be at least 13 years old to use the App.

If you are under the age of majority in your country/region, you represent that you have permission from a parent or legal guardian to use the App, and that they accept these Terms on your behalf.

3) No Account Required

The App does not require you to create an account or log in to use core features. Certain functionality such as restoring purchases depends on the app stores and/or third-party purchase infrastructure (see Section 7).

4) License to Use the App

Subject to these Terms, Abair grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on devices you own or control, in accordance with applicable app store rules.

All rights not expressly granted are reserved by Abair and its licensors.

5) Acceptable Use

You agree not to, and not to assist others to:

Copy, modify, distribute, sell, lease, or sublicense the App or any part of it
Reverse engineer, decompile, or attempt to extract the source code (except where prohibited by law)
Interfere with or disrupt the App, including through hacking, malware, or abuse of APIs/SDKs
Circumvent security or access restrictions
Use the App in any unlawful manner, or in a way that infringes any person’s rights

6) Intellectual Property

The App, including its content, design, text, graphics, audio, logos, and software, is owned by or licensed to Abair and is protected by applicable intellectual property laws.

You do not acquire any ownership rights in the App or its content by using it.

7) Purchases, Subscriptions, and Restore Purchases

A. In-App Purchases and Subscriptions

The App may offer consumable purchases (for example, coins) and subscriptions. Purchases are processed by Apple App Store or Google Play (the “Store”). Abair does not process or store your full payment information.

B. No Free Trial (unless explicitly shown in the Store)

The App does not offer a free trial unless a free trial is explicitly presented to you by the Store at the time of purchase.

C. Subscription Auto-Renewal and Cancellation

If you purchase an auto-renewing subscription, it will renew automatically until you cancel it through your Store account settings. Your Store account will be charged according to the subscription terms presented at checkout.

D. Refunds

Refunds are handled by the Store under its policies. Abair cannot issue Store refunds directly.

E. Restore Purchases

The App may include a Restore Purchases feature to restore eligible purchases and subscriptions on your device. Restoration depends on the Store and/or the purchase/subscription infrastructure used by the App. Abair does not guarantee restoration if the Store does not recognize the purchase or if the purchase is not eligible under Store rules.

8) Advertising

The App may display advertisements, including via third-party advertising services. Ads may change over time. Your device and third-party providers may provide settings to control certain ad preferences.

9) Third-Party Services and Links

The App may integrate third-party services (for example, advertising and purchase/subscription infrastructure) and may link to third-party websites. Those third parties are not controlled by Abair and may have their own terms and policies. Abair is not responsible for third-party services.

10) App Updates and Changes

We may modify, update, or discontinue the App (or any part of it) at any time. Some updates may be required for the App to continue functioning. You agree that the App may update automatically depending on your device settings.

11) Disclaimer

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law:

Abair disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Abair does not guarantee that the App will be uninterrupted, error-free, or that learning outcomes will be achieved
The App is an educational tool and does not provide professional advice of any kind

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

12) Limitation of Liability

To the maximum extent permitted by law, Abair and its directors, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the App.

To the extent liability cannot be excluded, Abair’s total liability for all claims in any 12-month period will be limited to the greater of:

the amount you paid to Abair through the App in the prior 12 months (if any), or
ZAR 100

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13) Indemnity

You agree to indemnify and hold harmless Abair and its affiliates, directors, employees, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your infringement of any rights of another.

14) Termination

Abair may suspend or terminate your access to the App at any time if you violate these Terms or if required for security, legal, or operational reasons. You may stop using the App at any time by uninstalling it.

Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law).

15) Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts located in South Africa, unless applicable consumer protection laws in your jurisdiction require otherwise.

16) Changes to These Terms

We may update these Terms from time to time. If changes are material, we may provide notice within the App or by other appropriate means. Continued use of the App after changes take effect means you accept the updated Terms.
