These Terms of Use (“Terms”) govern your use of Abair mobile applications, the website at https://abair.app and related services provided by ABAIR (PTY) LTD, trading as Abair (“Abair”, “we”, “us” or “our”).

By downloading, installing, accessing or using an Abair application or website, you agree to these Terms.

If you do not agree, do not use the relevant service.

2. Eligibility

You must be at least 13 years old to use an Abair application independently.

If you are under the age of legal majority where you live, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.

Users under 13 may only use an application where such use is expressly permitted, supervised by a parent or legal guardian and lawful under the applicable store rules and local law.

3. No Abair Account Required

Current core Abair applications do not require an Abair account, username or password.

Learning progress and settings are primarily stored locally on your device.

This means:

progress may not automatically transfer between devices;
uninstalling the application or clearing its storage may permanently remove progress;
restoring a purchase may restore access to purchased content but may not restore learning progress; and
Abair may not be able to recover lost locally stored information.

4. Licence to Use the Services

Subject to these Terms, Abair grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the applications and website for lawful personal and educational purposes.

You may use the application only on devices that you own or control and in accordance with applicable Apple, Google or other platform rules.

No ownership rights are transferred to you.

5. Acceptable Use

You must not:

copy, reproduce, sell, rent, lease, sublicense or commercially exploit the applications or content without written permission;
reverse engineer, decompile or attempt to extract source code, except where applicable law expressly permits it;
bypass payment, entitlement, security or access controls;
interfere with the operation, security or availability of the applications or website;
introduce malware, automated attacks or harmful code;
scrape, systematically download or republish content;
use the services to violate another person’s rights;
misuse support, privacy or contact channels;
impersonate another person or organisation; or
use the services for unlawful, fraudulent or abusive purposes.

6. Intellectual Property

The applications, website and associated materials—including software, source code, design, layout, lessons, stories, text, illustrations, audio, trademarks, logos and other content—are owned by or licensed to ABAIR (PTY) LTD.

They are protected by copyright, trademark and other applicable laws.

“Abair” and associated branding may not be used in a manner that suggests endorsement, partnership or affiliation without written permission.

7. Educational Content

Abair is an educational tool intended to support language learning and practice.

We do not guarantee:

fluency;
a specific examination result;
employment or academic outcomes;
complete linguistic accuracy in every context;
that every translation has only one valid interpretation; or
that the service is suitable for professional legal, medical, immigration or emergency translation.

Users should obtain qualified professional assistance where accuracy is legally, medically or commercially critical.

8. Purchases and Paid Features

Different Abair applications may offer different paid products, including:

one-time purchases;
lifetime access;
consumable virtual items;
monthly or yearly subscriptions; and
premium content or features.

The price, billing period and applicable conditions are displayed before purchase.

Purchases are processed by Apple, Google or another authorised app-store platform.

Abair does not directly process or store complete payment-card details.

9. Subscriptions

Where an application offers an automatically renewing subscription:

the subscription renews unless cancelled through the applicable store;
the store account may be charged within the period disclosed at checkout;
cancellation must be completed through the Apple or Google account used for the purchase;
deleting the application does not cancel a subscription; and
access normally continues until the end of the paid billing period, subject to store rules.

Any trial, introductory price or promotional period applies only when expressly shown during checkout.

10. Refunds

Refund requests are administered by the store through which the purchase was made.

Abair cannot normally issue a direct refund for a transaction processed by Apple or Google.

Nothing in these Terms excludes any refund or consumer right that cannot lawfully be excluded.

11. Restore Purchases

Certain applications provide a Restore Purchases function.

Restoration depends on:

the app store recognising the original purchase;
the same or eligible store account being used;
the product remaining available;
the purchase being restorable under store rules; and
the relevant entitlement or subscription infrastructure functioning correctly.

Consumable items may not be restorable.

Restore Purchases concerns purchased access.

It does not guarantee restoration of locally stored progress, streaks, rewards or settings.

12. Virtual Items

Where an application provides coins, rewards, streaks or other virtual items:

they have no cash value;
they cannot be exchanged for money unless expressly required by law;
they may be application-specific;
they may be lost when local data is cleared;
they may be modified or discontinued as the application changes; and
they do not create a bank, investment or stored-value account.

13. Advertising

Certain applications may display third-party advertising.

Advertisements and advertisers are not necessarily endorsed by Abair.

Abair is not responsible for the independent products, websites, representations or privacy practices of advertisers.

Advertising choices may be available through the application, device settings, operating system or advertising provider.

14. AI, Speech and Experimental Features

Certain current or future Abair services may use speech synthesis, machine learning, recommendation systems, pronunciation assessment or generative technology.

Such features may:

produce incomplete or inaccurate results;
depend on third-party cloud services;
be changed, limited or withdrawn;
require microphone, network or device permissions; and
be labelled as beta, experimental or in development.

You remain responsible for checking generated or automated content before relying on it.

Abair will provide additional notices and request permissions where required before processing microphone recordings, prompts or other user-provided content.

16. Third-Party Services

The applications and website may rely on or link to third-party services, including:

Apple App Store;
Google Play;
advertising providers;
subscription and entitlement providers;
cloud-hosting providers;
payment infrastructure;
social networks; and
external websites.

Third-party services operate under their own terms and privacy policies.

Abair is not responsible for an independent third party’s service, content or availability, except to the extent required by law.

17. Application Updates

We may release updates to:

add or remove features;
improve security or performance;
correct errors;
comply with platform or legal requirements;
update content; or
change compatibility.

Certain updates may be necessary for the application to continue operating.

We do not guarantee indefinite support for every device, operating-system version, application version, language course or feature.

18. Availability and Changes

We may modify, suspend or discontinue all or part of a service where reasonably necessary for operational, security, legal or commercial reasons.

We do not guarantee that every service will be uninterrupted, error-free or available in every location.

Where reasonably practical, we will avoid unnecessarily interfering with paid access and will comply with mandatory consumer requirements.

19. User Feedback

If you voluntarily provide feedback, suggestions or ideas, you permit Abair to use that feedback to improve its products without an obligation to compensate you.

This does not transfer ownership of your independently created confidential materials unless separately agreed in writing.

20. Disclaimer

To the maximum extent permitted by law, the applications and website are provided on an “as is” and “as available” basis.

Abair does not guarantee:

continuous or error-free availability;
compatibility with every device;
permanent preservation of locally stored information;
that every item of content will be free from errors;
that every feature will remain available; or
any particular educational, commercial or personal result.

Nothing in these Terms excludes a warranty, right or remedy that cannot lawfully be excluded under applicable consumer law.

21. Limitation of Liability

To the maximum extent permitted by law, ABAIR (PTY) LTD and its directors, employees, contractors and licensors will not be liable for indirect, incidental, special, punitive or consequential loss arising from use of or inability to use the services.

This includes loss of locally stored progress, loss of opportunity or loss caused by a third-party service.

Where liability cannot legally be excluded, our liability will be limited to the amount reasonably permitted by applicable law and, where relevant, the amount paid for the affected service during the preceding 12 months.

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence or another liability that cannot lawfully be limited.

22. Indemnity

To the extent permitted by law, you agree to be responsible for losses or claims resulting directly from:

your unlawful misuse of the services;
your deliberate violation of these Terms; or
your infringement of another person’s legal rights.

This section does not require a consumer to indemnify Abair where doing so would be unlawful or unfair under mandatory consumer law.

23. Suspension and Termination

We may restrict or terminate access where reasonably necessary because of:

a serious or repeated violation of these Terms;
fraud or abuse;
security threats;
legal or platform requirements; or
discontinuation of the service.

You may stop using an application at any time by uninstalling it.

Uninstalling does not automatically cancel an active subscription.

24. App-Store Terms

Where an application is downloaded through Apple or Google:

the applicable store’s terms also apply;
the store processes the purchase and may administer refunds;
the store is not responsible for Abair’s educational content or support, except where its own terms provide otherwise; and
if these Terms conflict with mandatory store terms, the mandatory store terms apply to the extent of the conflict.

25. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Disputes will be handled by courts with lawful jurisdiction in South Africa, unless mandatory consumer law gives you the right to bring a claim elsewhere.

Before commencing formal proceedings, the parties should attempt in good faith to resolve the dispute through written communication.

26. Changes to These Terms

We may update these Terms when our products, legal obligations or business operations change.

The effective date at the top identifies the latest version.

Where a change is material, we may provide notice through the application, website or store listing.

Your continued use after the updated Terms take effect indicates acceptance, except where applicable law requires another form of agreement.
